For a long time, Kant’s Doctrine of Right languished in relative neglect, even among Kantians. The work was best known for its uncompromising views on punishment and revolution, and for a seemingly limited and not particularly original emphasis on private property. Kant’s more interesting political claims were often said to be located elsewhere: in the third Critique (Hannah Arendt, Patrick Riley), or the structure of the critical project (Onora O’Neill). When John Rawls explained why his theory of justice (...) could be given a ‘Kantian interpretation’, he drew on concepts found just in Kant’s moral philosophy, bypassing the Doctrine of Right entirely. -/- In recent years, however, there has been an expanding body of work on the Doctrine of Right, by writers like B. Sharon Byrd and Joachim Hruschka, Arthur Ripstein, Elisabeth Ellis, and Lea Ypi. Ripstein and Ellis, in particular, have sought to reframe the arguments of Kant’s text in terms more congenial to contemporary legal and political theory. But can Kant’s arguments really be applied to twenty-first-century political debates? -/- The authors in this collection of essays explore this question in different ways, by looking at different aspects of Kant’s text. What is distinctive about Kant’s conception of the social contract, or human rights? Can a Kantian political philosophy concern itself with poverty and welfare rights? Can a Kantian affirm a conception of civil disobedience? What kind of view should a Kantian have of international relations? Can Kant’s views on punishment be reconciled with a conception of forgiveness? What would a Kantian position be in contemporary debates about marriage? -/- The authors of this volume do not always agree with one another, but they always seek to be faithful to the text, and to understand what a political position grounded in the Doctrine of Right would look like in twenty-first-century terms. A dispositional theory of skill, such as that defended by Stanley and Williamson, might seem promising. Such a theory looks to provide a unified intellectualist account of skill reflecting insights from cognitive science and philosophy. I argue that any theory of the kind fails given that skill is broadly answerable to the will. A person may be characteristically disposed both against the exercise of her skill and against any associated intentional forming of knowledge. Clearly she does not cease thereby to (...) be skilled. If you slide far enough down the slippery slope envisioned by opponents of medical assistance-in-dying (MAiD), you eventually land in a ghastly society with industrialized euthanasia, rampant suicide, and devalued life. But what if the slippery slope leads us somewhere better? This paper explores the benefits of eliminating nearly all MAiD prohibitions and regulations. We anticipate three positive effects for public health: 1. Expanded access to those currently not qualified from MAiD by removing ineffective access criteria; 2. Harm reduction by (...) making MAiD safer and by rerouting suicidal patients into alternate care; and 3. Improvements to the health system through lowered healthcare costs and increased patient activation in end-of-life care. Safeguards and prohibitions deny those who wish to die the ability to do so to prevent the _potential_ danger of a few being subjected to an undesired early death. (shrink)

Is implementing the beneficent nudge program morally permissible in worlds like ours? I argue that there is reason for serious doubt. I acknowledge that beneficent nudging is highly various, that nudges are in some circumstances morally permissible and even called for, and that nudges may exhibit respect for genuine autonomy. Nonetheless, given the risk of epistemic injustice that nudges typically pose, neither the moral permissibility of beneficent nudging in the abstract, nor its case-by-case vindication, appears sufficient to justify implementing a (...) nudge program in worlds like ours. Drawing on Miranda Fricker’s account of epistemic injustice, I argue that the cogent defense of any nudge program, relative to worlds like ours, stands in need of serious attention to its potential for fostering or sustaining epistemic injustice. A more specific point hinges on recognizing a form of epistemic injustice not enough attended to in the literature to date, which I call reflective incapacitational injustice. This includes relative disadvantages in the attaining of the capacity to engage in critical reason, such as the capacity to go in for potentially critical reasoned deliberation and discursive exchange concerning ends. Since Cass Sunstein’s First Law of behaviorally informed regulation would be taken, in worlds like ours, to justify indeterminately many nudges leading to such epistemic injustice we have general grounds for doubting the moral permissibility of this nudge program. We should hence oppose the implementation of any such program until it is shown not to violate the demands of epistemic justice. (shrink)

The recent wave of medical assistance in dying legalisation raises questions about proper oversight of the practice as new systems for data collection, case assessment and public reporting emerge. Newer systems, such as in Spain, New Zealand and Colombia, are eschewing the retrospective approach used for case assessment in older systems, particularly those in the Netherlands, Belgium and the USA, in favour of an approach requiring more extensive review prior to the procedure. This shift aims to increase compliance with each (...) jurisdiction’s specific safeguards and legal criteria as well as to protect vulnerable patients, but also risks stifling access to the practice and increasing administrative burden on clinicians and patients. Newer systems also tend to favour more extensive data collection than older systems, while failing to be as transparent with public reporting. Inconsistency in data collection and public reporting make it difficult for researchers, policymakers and the public to assess the practice and help achieve a balance between access and compliance. Research on oversight activities is sparse, and there is a need for clarity to determine how best to handle violations of the law and how to create best practices. (shrink)

Rationale: Deep brain stimulation (DBS) of the hippocampus is proposed for enhancement of memory impaired by injury or disease. Many pre-clinical DBS paradigms can be addressed in epilepsy patients undergoing intracranial monitoring for seizure localization, since they already have electrodes implanted in brain areas of interest. Even though epilepsy is usually not a memory disorder targeted by DBS, the studies can nevertheless model other memory-impacting disorders, such as Traumatic Brain Injury (TBI). Methods: Human patients undergoing Phase II invasive monitoring for (...) intractable epilepsy were implanted with depth electrodes capable of recording neurophysiological signals. Subjects performed a delayed-match-to-sample (DMS) memory task while hippocampal ensembles from CA1 and CA3 cell layers were recorded to estimate a multi-input, multi-output (MIMO) model of CA3-to-CA1 neural encoding and a memory decoding model (MDM) to decode memory information from CA3 and CA1 neuronal signals. After model estimation, subjects again performed the DMS task while either MIMO-based or MDM-based patterned stimulation was delivered to CA1 electrode sites during the encoding phase of the DMS trials. Each subject was sorted (post hoc) by prior experience of repeated and/or mild-to-moderate brain injury (RMBI), TBI, or no history (control) and scored for percentage successful delayed recognition (DR) recall on stimulated vs. non-stimulated DMS trials. The subject’s medical history was unknown to the experimenters until after individual subject memory retention results were scored. Results: When examined compared to control subjects, both TBI and RMBI subjects showed increased memory retention in response to both MIMO and MDM-based hippocampal stimulation. Furthermore, effects of stimulation were also greater in subjects who were evaluated as having pre-existing mild-to-moderate memory impairment. Conclusion: These results show that hippocampal stimulation for memory facilitation was more beneficial for subjects who had previously suffered a brain injury (other than epilepsy), compared to control (epilepsy) subjects who had not suffered a brain injury. This study demonstrates that the epilepsy/intracranial recording model can be extended to test the ability of DBS to restore memory function in subjects who previously suffered a brain injury other than epilepsy, and support further investigation into the beneficial effect of DBS in TBI patients. Introduction The General Medical Council stipulates that doctors must be competent professionals, not merely scholars and practitioners. Medical school curricula should enable students to develop professional values and competencies. Additionally, medical schools are moving towards integrated undergraduate curricula, Cardiff's C21 being one such example. Methods We carried out an audit to determine the extent to which C21 delivers GMC professionalism competencies, and a student questionnaire to explore student perspective on ethics and professionalism. Results and discussion C21 delivers explicit or implicit (...) teaching for all major GMC competencies, though some missed opportunities remain. The questionnaire responses showed that most students value ethics and professionalism teaching, and that it is most well received when delivered in a variety of ways and contexts throughout the curriculum. We also note that some respondents confuse ethics and professionalism with the policing of student behaviour. Conclusions C21 and curricula like it offer many opportunities for nurturing ethically and professionally competent physicians. Students appear to value this, though there remains confusion between medical school discipline and ethics and professionalism which needs further explication. (shrink)

Snap‐shots of live theatre: the use of photography to research governance in operating room nursing The use of photography is an underreported method of research in the nursing literature. This paper explores its use in an ethnographic research project, the fieldwork of which was undertaken by the first author. The aim was to examine the governance of operating room nursing in the clinical setting and the theoretical orientation was the work of Michel Foucault. The focus of this paper is on (...) how photography was used as a means of data generation. To establish some context we begin by drawing on writers from sociology and anthropology to provide an overview of the status of vision and visual research methods in contemporary social research. We then move to a brief discussion of the uses of photography in social research and the limitations imposed by ethical considerations of its use in clinical nursing settings. As well, the process and approach involved in this research project, and issues of analysis are discussed. Three ‘snap‐shots’ of operating room nursing, taken by participants, are presented. Each is analysed in terms of its contributions to the research process as well as its substantive contribution to the theoretical framework and the research aims. (shrink)

Although Lynn White, jr. is best known for the critical aspects of his disputed 1967 essay, “The Historical Roots of Our Ecologic Crisis,” this article combines archival research and findings from his lesser-known publications in an attempt to reconcile his thought on democracy with the Earth Charter and its assertion that “we are one human family and one Earth Community with a common destiny” . Humanity is first and foremost, White believed, part of a “spiritual democracy of all God's creatures” (...) in which humans and nonhumans should treat each other with mutual compassion and courtesy. It is argued that the Christian, animal-inclusive “biodemocracy” envisioned by White is both compatible with, and potentially in conflict with, the tenets of the Earth Charter. This article also considers further implications of these findings for the larger fields of ecotheology and religion and ecology. (shrink)

Their common aim is to explore the connections between the Earth Charter and the concept of biodemocracy with the intention of highlighting ways of thinking about the relationship between science, religion, and the environment in the twenty-first century. Utilitarians and their critics commonly assume that maximizing utilitarianism necessarily aggregates over cardinal comparable personal utility rankings that are homogeneous in quality independently of their sources or objects, whether utility is conceived in terms of pleasure or preference satisfaction. Although familiar versions of utilitarianism, crude or sophisticated, do make such rich homogeneous utility information part of the very meaning of the doctrine, utilitarian philosophy loses credibility as a result. A more credible version of maximizing utilitarianism along John Stuart Mill's lines (...) relies instead on plural kinds of ordinal non-comparable personal utilities that are heterogeneous in quality. One kind of utility is qualitatively superior to another if and only if the higher kind is more valuable than the lower kind irrespective of quantity. Given that the kind of utility associated with the moral sentiment of justice is qualitatively superior to any competing kinds, Mill's pluralistic ordinal utilitarianism gives absolute priority to a social code of equal rights and duties over competing considerations. Some key practical implications of this extraordinary utilitarianism are discussed with reference to various examples of the sort discussed in the literature. (shrink)

Every doctoral thesis requires contextualization within its specific discipline's theoretical bases. For a visual arts practice-based thesis, the relevant bases include those of aesthetics and visual perception. This article reviews a Western history of the domain of visual aesthetic theory, addressing both the _analytical_ philosophical efforts to define art and the _continental_ approaches, which construe art as social construction. It then reviews a third, normative stance that foregrounds cognitive value before definition or sociological context—an _aesthetic cognitivist_ position, art practice as (...) a means of acquiring and sharing experiential knowledge and understanding. Contemporary concerns about environmental aesthetics and somaesthetics are also addressed in the Introduction. Aesthetic theories are related to visual perception theories as an aid to fulfilling the scholarly requirements for a practice-based thesis. (shrink)

What was the connection between the structure of the German economy in the 1930s and German aggression in World Warii? Adam Tooze’sWages of Destructionforcefully poses this issue, but fails to adequately resolve it. Instead, on this decisive question, his analysis oscillates uneasily between two equally unconvincing models: rational-choice theory and cultural determinism. This surprising explanatory failure derives from an inadequate theorisation of German imperialism as the expression of the combined and uneven development of the German economy and society in the (...) late-nineteenth and early-twentieth centuries. A claim that certain purely private matters should be beyond the reach of society's laws, moral rules, and other customs is central to the distinctive liberalism of John Stuart Mill. On Liberty, perhaps the most eloquent defense of individual liberty ever written, laments the hostility allegedly displayed in modern mass societies toward “the right of each individual to act [in private matters] as seems good to his judgement and inclinations”. In Mill's view, a free society must design its institutions with (...) due regard for what he terms “individuality.” That is, public authority, whether in the form of law, customary opinion, or economic power, must be self-limiting so that it does not interfere with the rights of individuals to choose as they like with respect to such private concerns as religious faith, reading materials, living companions, and consumption of drugs and alcohol. Individuals and voluntary groups should be permitted to do whatever they prefer within their private spheres even if everyone else in society dislikes what they do, is annoyed by them, and actually chooses not to be around them or to befriend them. I am therefore delighted when Professor Donald Rutherford, the author of that superb book, Leibniz and the Rational Order of Nature, generously describes my Leibniz’ Universal Jurisprudence: Justice as the Charity of the Wise as “a wonderful achievement.” I am especially pleased that he thinks I made a respectable case for Leibniz’ anti-Hobbesian, Christian-Platonist definition of justice as caritas sapientis seu benevolentia (...) universalis, “the charity of the wise, that is, universal benevolence.” For, as I said in my Conclusion, “Obviously a social world fully and completely governed by the Leibnizian principle of justice as ‘wise charity’ would be a good one, and certainly better than our present social world... Who can doubt that the world would be better if Leibnizian universal jurisprudence were in place—if every rational substance in the universe not only refrained from harm [the neminem laedere of Roman law] but rejoiced in the ‘perfection’ of others?... Only an ungenerous heart would fail to be moved by so generous a moral vision.” That generous moral vision, I suggested, comes out most eloquently in La véritable piété of 1710. (shrink)

The latest volume of Political Writings in the great Berlin-Brandenburg Academy Edition of Leibniz’ Sämtliche Schriften und Briefe reveals once again the astonishing range of Leibniz’ contributions to the political-moral-legal sphere: more than 900 pages document Leibniz’ reflections on augmenting public well-being through new academies of science, on the policies of the Imperial court in Vienna, on the improvement of Imperial finances and military readiness, on the political history of Sachsen-Lauenburg, on the interests of Hannover-Brunswick, on European politics, on “church (...) politics” and ecumenism, on the overcoming of “schism” through wise charity, on coinage and commemorative medallions, even on pensions and life-insurance.. What holds this far-flung, wide-ranging collection together, however, achieving Leibnizian “unity in multiplicity”—as the learned editor of Vol. 4, Dr. Hartmut Rudolph, makes clear in his illuminating Introduction—is Leibniz’ devotion to “the common good;” for Rudolph is entirely right to say that Leibniz reveals his affection for the bonum commune, “the general best,” in a characteristic letter to Emperor Leopold I from 1688: “My entire purpose now,” Leibniz says, “is to forward the general good [das gemeine Beste] through the few talents which God has given me. And this concern for le bien général is crowned, in the present Volume 4, by Leibniz’ magisterial Memoir for Enlightened Persons of Good Intention—of which we finally have a wholly reliable text, thanks to Dr. Rudolph and his colleagues at the Leibniz Arbeitsstelle in Potsdam. The latest volume of Leibniz’ Politische Schriften, in the great Akademie-Ausgabe of the Sämtliche Schriften und Briefe, reveals the astonishing range of Leibniz’ political-moral-legal-religious-scientific-cultural concerns: if the first, largest and most important section of this new fifth volume deals with justice and law, that is only to be expected, since Leibniz’ doctoral degree was in law and jurisprudence, and since he served as jurisconsult and “intimate counsellor of justice” to an ever-expanding circle of European rulers: first the Elector of Mainz, (...) then the house of Hannover, then the King of Prussia in Berlin, the Emperor in Vienna, and Czar Peter the Great.. But Politische Schriften vol. 5 also treats “church policy” and charitable religious reconciliation—including a Latin memorial poem on the death of benevolently ecumenical Huguenot-turned-Catholic Pellisson ; the raising of Hannover to the status of an Electorate within the Holy Roman Empire; and the relations of the Reich with Europe, especially with the France of bellicose Louis XIV. Moreover vol. 5 takes up “health policy,” the improvement of the coinage, and numerous schemes for the rational re-ordering of the ducal libraries of Hannover and Wolfenbüttel, with emphasis on books in the so-called “higher-faculties”. And all of these apparently diverse, seemingly scattered matters are coherently linked by Leibniz’ charitable concern for le bien général du genre humain: “Provided that something of importance is achieved, I am indifferent whether it is done in Germany or France, for I seek the good of mankind. I am neither a phil-Hellene nor a philo-Roman, but a philanthropos.”. (shrink)

The book contains chapters on the prominence of scepticism in schools; the theory of evolution and false theology; and the sacred scriptures.

How does mutual intelligibility impact the political sphere? This paper uses Wittgenstein’s Philosophical Investigations as a means of examining this connection. I argue that Wittgenstein’s paradigm of a dialectical world suggests that his analysis of mutual intelligibility in understanding experiences is necessary in a pluralistic democracy. I conclude that via his theory of social reality politics is a dynamic dialectical process of communicating experiences.
